On 11 June 2021, the German Parliament adopted the draft Act on Corporate Due Diligence Obligations in Supply Chains. This is one step ahead of the European Union, which is currently working on a similar set of regulations on corporate due diligence and accountability for human rights, environmental and governance impacts within an enterprise's business and throughout its supply chain.
The main objective of the German Supply Chain Act is the compliance of German enterprises and their suppliers – both in Germany and abroad (e.g. Thailand) – with established human rights and environmental standards. It thus departs from the previous (voluntary) soft law approach in favour of a mandatory framework for enterprises to comply with the UN Guiding Principles on Business and Human Rights.
The new law will come into force on 1 January 2023. This seems far in future, but businesses are advised to timely begin preparations for the implementation of the new statutory requirements.
This presentation targets (German) enterprises with subsidiaries in Thailand as well as local companies working with partners in Germany, providing an overview of the following topics:
