Arbitration and Alternative Dispute Resolution (ADR), worldwide continues to gain significant recognition, massive popularity, and wide acceptance as not just the primary and preferred means but also the most effective means of dispute resolution outside the traditional courtrooms. The relative ease of enforcement of arbitral awards worldwide, coupled with the numerous advantages which Arbitration and ADR offer over the traditional court system, have contributed to the growing popularity of Arbitration and ADR globally. With the ever-growing increase in globalisation of trade, it is projected that Arbitration and ADR would further enhance the amicable resolution of international disputes and also boost the confidence of parties. It is therefore pertinent for the practice of Arbitration and ADR in Africa to appreciate significantly, such that Africa will be recognised globally as a leading hub for resolving domestic, regional, and international disputes.

With the exponential growth in international business transactions around the globe, an increase in cross-border activities also necessitates the settlement of cross-border disputes even when parties need more willingness to submit to a particular jurisdiction. This hurdle makes the utilisation of cross-border Arbitration in resolving cross-border disputes more difficult, mainly due to the need for recognition and enforcement of arbitral awards. From a practical perspective, this aged-long hurdle still poses specific difficulties, uncertainties and challenges, including but not limited to the resolution of international cross-border disputes. Hence, there is a need to harness the strengths of Arbitration proceedings to resolve issues in multiple jurisdictions and conflicts of laws and seek enforcement of such awards.

Commercial and investor-state arbitration in Nigeria has become a concern due to the increasing number of disputes arising from it. This has led to debates about the fairness and transparency of the system. One of the major concerns about commercial arbitration is the high cost of arbitration, which makes it inaccessible to smaller businesses and individuals. This has led to calls for establishing more affordable and transparent arbitration processes. Another concern is the lack of diversity in the appointment of arbitrators, which can lead to biased decisions. In addition, the enforceability of arbitral awards has been a major challenge due to inadequate legal frameworks and lack of compliance by some parties.

An Arbitrator plays a fundamental role towards ensuring that the aim of justice is guaranteed in an Arbitration proceeding. Amidst these numerous roles, the core of an Arbitrator’s role also demands that an Arbitrator maintains an equidistant position with the parties. Albeit, the concept of bias is subjective. Nevertheless, bias must be appropriately managed by an Arbitrator without any manifestation of biased conduct(s). This way, an Arbitrator can salvage the possible suspicion and, consequently, the unjustifiable challenge of an award. However, this does not deprive Arbitrators of their powers to exercise their discretion in the best way possible without contravening arbitration rules/practices to ensure that justice is not only done in the delivery of an award but must be seen to have been done.

Arbitration is one of the most preferred options in resolving disputes in cross-border commercial transactions. The increase in recognition and enforcement of awards is one of the various considerations for resorting to it. Arbitration clauses are the fine print of all contracts upon which arbitration is established. African countries have risen along with others in ratifying the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards. Similarly, Article 27 of the AFCFTA Protocol provides for arbitration as an alternative route to resolving disputes (a very good signal of confidence in arbitration). Despite these bold steps, numerous challenges exist to the recognition and enforcement of arbitral awards encountered by most African States.

As widely practised as Arbitration is, specific jurisdictional trends still exist, including but not limited to delocalisation, expedited proceedings, multi-contract arbitration, procedural innovations, electronic filing of arbitration pleadings, and technological advantage. Delocalisation, for instance, came to life due to the willingness of parties to submit to a neutral arbitral process against the arbitral laws of the parties’ respective countries. Beyond this, the UAE Arbitration Law, Dubai International Arbitration Centre (2022) Rules encourages the use of technology during Arbitration hearings and deliberations and its procedural innovations aimed at reducing time, cost and environmental concerns. Are there similar provisions in the laws guiding Arbitration and ADR in the USA and Australia? Any lessons for Nigeria and Africa generally?

On the 26th of May 2023, Nigeria passed the new Arbitration and Mediation Act, 2023, which repealed the Arbitration and Conciliation Act, Cap. 18A, LFN 2004, after about thirty-five (35) years in operation. The new Arbitration and Mediation Act has been described to be a more comprehensive legal framework for the conduct of Arbitration and Mediation proceedings in Nigeria, giving room for initiatives and utilisation of technological innovations towards increased operational efficiency and effective dispute resolution either by Arbitration and or Mediation, including but not limited to New Technologies (NT), Technology Mediated Dispute Resolution (TMDR), Online Dispute Resolution (ODR) and Hybrid Alternative Dispute Resolution (HADR).

Arbitration and extensively Alternative Dispute Resolution, just like the traditional court system, is geared towards ensuring justice. While Arbitration does not conform with procedural dictates of the traditional court system, it nevertheless produces the same substantive outcome. With this understanding, it stands to reason that Arbitration is no less an inferior dispute resolution mechanism and should be further enhanced to increase how the public can also access this justice system. Moreover, the current overwhelming state of our traditional court system has further necessitated the urgency to revisit the role the traditional arbitration and Alternative Dispute Resolution have played towards fostering the growth of justice delivery in Nigeria.

Remarks by Guest of Honour, Hon. Mr. Justice Olukayode Ariwoola GCON (Chief Justice of Nigeria) Dr. Gaston Kenfack, (President, Association for the Promotion of Arbitration in Africa (APAA), Douala)

MITIGATING AND ARBITRATING CONSTRUCTION DISPUTES: LESSONS AND IMPACT FOR AFRICAN STATES AND NIGERIA The first challenge of the manufacturing industry is encountered when a non-efficient and ineffective disputes resolution mechanism is adopted during the construction and installation phases of the required infrastructure(s) and machineries. This session examines the current trend in resolving construction disputes in Nigeria and highlights the need to adopt the global trend. Break

UNITED NATIONS COMMISSION ON INTERNATIONAL TRADE LAW, MEDIA PARTNERS 2023 ANNUAL CONFERENCE.
The United Nations Commission on International Trade Law (UNCITRAL), established by the United Nations General Assembly by resolution 2205 (XXI) of 17 December 1966 (see annex I), plays an important role in developing that framework in pursuance of its mandate to further the progressive harmonization and modernization of the law of international trade by preparing and promoting the use and adoption of legislative and non-legislative instruments in a number of key areas of commercial law. Those areas include dispute resolution, international contract practices, transport, insolvency, electronic commerce, international payments, secured transactions, procurement and sale of goods. These instruments are negotiated through an international process involving a variety of participants, including member States of UNCITRAL, nonmember States, and invited intergovernmental and non-governmental organizations. As a result of this inclusive process, these texts are widely accepted as offering solutions appropriate to different legal traditions and to countries at different stages of economic development. In the years since its establishment, UNCITRAL has been recognized as the core legal body of the United Nations
system in the field of international trade law.
VIENNA, 3 April (UN Information Service) – Representatives of more than 95 State delegations and 50 international organizations gathered at the United Nations Headquarters in New York to complete the first set of reforms in investor-state dispute settlement (ISDS), which Working Group III of the United Nations Commission on International Trade Law (UNCITRAL) has been mandated to carry out.
The Working Group completed its work on a draft code of conduct for arbitrators in international investment dispute resolution. The draft code of conduct for arbitrators reinforces the duty of independence and impartiality, broadens the disclosure requirement, and regulates the practice of so-called double-hatting. The Working Group also completed its work on a draft code of conduct for judges in a standing mechanism. A standing mechanism is another reform that the Working Group is currently considering.
To encourage the use of mediation to resolve investment disputes, the Working Group also completed the draft provisions on investment mediation for possible inclusion in investment treaties and draft guidelines on investment mediation, which will provide guidance to parties on the use of mediation in investor-state dispute settlement.

THE ORGANIZATION FOR THE HARMONIZATION OF BUSINESS LAW IN AFRICA, MEDIA PARTNER 2023 ANNUAL CONFERENCE
The Organization for the Harmonization of Business Law in Africa (abbreviated as OHADA) is an intergovernmental organization for legal integration. It was established by the Treaty of 17 October 1993 signed in Port Louis (Mauritius), as revised on 17 October 2008 in Quebec (Canada). To date, this organization brings together 17 African countries and remains open to any member state of the African Union, or any State which, though not a member of the AU, is invited to join by common consent of the OHADA Member States.
OHADA was created in the context of an acute economic crisis and a drastic fall in investment levels in Africa. Legal and judicial insecurity were identified as a major cause of investor distrust. The obsolescence, disparity, and inaccessibility of rules governing economic operations led to legal insecurity materialized by the difficulty of determining the applicable rule in a given operation. The situation was compounded by the poor state of courts, inadequate judicial personnel, and the lack of stakeholder training in business law, judicial delays, and problems of professional ethics. To remedy the situation, OHADA was tasked with streamlining the legal environment of companies in order to guarantee the legal and judicial security of economic activities, with a view to stimulating investment and creating a new development pole in Africa.
To achieve this, OHADA:
produces simple, up-to-date, harmonized, and suitable business laws for its Member States, in order to facilitate business activities. The law is contained in Uniform Acts which, once adopted, apply equally in all Member States. Ten Uniform Acts have been adopted so far;
ensures that the harmonized law is applied with due diligence, under conditions that guarantee the legal security of economic activities. This objective is achieved by securing the legal settlement of business litigations and by promoting alternative methods of dispute resolution.
