More and more, public entities are confronted with groups or individuals who intend to test the boundaries of free speech and the right to gather information in public spaces by recording and observing public officials or law enforcement activities, claiming to be doing so to ensure transparency and accountability. In many instances, these individuals aggressively attempt to bait the public official or law enforcement officer to take improper action against them so they can post the video for t...
More and more, public entities are confronted with groups or individuals who intend to test the boundaries of free speech and the right to gather information in public spaces by recording and observing public officials or law enforcement activities, claiming to be doing so to ensure transparency and accountability. In many instances, these individuals aggressively attempt to bait the public official or law enforcement officer to take improper action against them so they can post the video for their followers and, ultimately, to bring legal action against the entity.

It is crucial for public entities to:
*Understand the legal rights of First Amendment Auditors,
*Proactively plan to minimize the interruption to public services by First Amendment Auditors,
*Effectively navigate encounters with First Amendment Auditors when they inevitably occur;
*Avoid damage to Entity reputation and costly litigation.

This session will provide practical guidance for public entity leaders, at all levels, to help them navigate this difficult and potentially costly issue.

Speakers

Laura Abrams

Ms. Abrams, founder of The Abrams Law Firm, has been representing public entities in Ohio since 1993. She was named an Ohio Super Lawyer Rising Star in the area of “Cities and Municipalities” in 2005 and is presently the Law Director of Springfield Township and the Village Solicitor for the Village of Glendale.

Ms. Abrams is an active member of the legal community in Southwest Ohio. She has been a member of the Cincinnati Bar Association Grievance Committee from 1998 to 2010 and from 2012 to present. Ms. Abrams is currently the Vice-Chair of that Committee and will assume the role of Chair in May of 2016. Ms. Abrams has served as an Unofficial Referee in the Hamilton County Unofficial Referee Program since 1996. She was a member of Class X of the Cincinnati Academy of Leadership for Lawyers and was active in developing the Cincinnati Public Schools Truancy Mediation program in 2006. She has been a member of the Batavia Township Board of Zoning Appeals since 2001 and now serves as its Chair.

Ms. Abrams has argued cases before the Ohio Supreme Court and presented cases to the U.S. Supreme Court, the U.S. Fifth, Sixth, and Ninth Circuit Courts of Appeals, and the First, Second, and Twelfth District Courts of Appeals in Ohio. Ms. Abrams has also argued cases in arbitrations throughout Ohio and presented cases in hearings and mediations before the State Employment Relations Board.

Ms. Abrams has worked with State and local legislators to draft legislation of importance to insuring the efficiency of political subdivisions throughout Ohio.

Ms. Abrams is a cum laude graduate of the University of Cincinnati College of law, where she was an editor of the Law Review. After graduation, Ms. Abrams served as a clerk for the Honorable William H. Wolff, Jr. of the Second District Court of Appeals in Ohio. She left the Court to join the nationally -recognized firm of Sirkin, Pinales, Mezibov & Schwartz, where she led the firm’s governmental and administrative law practice and became a partner before leaving to establish The Abrams Law Firm.

Ms. Abrams joined the Ohio Plan as its General Counsel in 2012 and has worked with the Board to ensure the Ohio Plan’s compliance with laws and regulations and maintenance of procedures and processes to insure the integrity of the Plan. In 2015, the Board of Directors of the Ohio Plan voted to install Ms. Abrams as the Plan’s first Executive Director, to establish an office in Cincinnati, and to work with the Ohio Plan’s Chairman and Executive Assistant to explore ways in which the Ohio Plan can better serve its Members in today’s ever-changing environment.
