3. The FinTech Boom: Analysis, Trends, and Future

Fintech is shaking up the region. Latin America is poised to become a global leader in digital banking and it is a region on the rise. A large segment of the population was ignored by the traditional banks and the pace and focus of digital disruptions have given birth to several fintech solutions such as digital banks, payments, wallets, lenders and more. The new course has forced traditional banks to ride the fintech wave and there are enormous opportunities.

    Luís Alberto Laboissière Ambrósio has more than 25 years of experience in financial law. He joined the Firm in 2015. He is a partner of the Corporate and Finance practice group. His work and expertise are focused on debt, both local and international. He has a wide breadth of experience in bank financing operations, capital market, project finance and debt restructuring, having participated in high profile cases.

    He was the main legal advisor of Bank of America, the largest financial creditor in the Parmalat’s judicial recovery, which established several legal precedents, as well as for the International Finance Corporation – IFC, in respect of the first offer of debt securities in the Brazilian capital market by a multilateral organization. Luis Ambrósio frequently represents financial institutions and corporate clients in highly complex financial transactions.

    Gabriel Gómez Giglio is the Chair of the Latin American Banking & Finance Practice of Baker McKenzie and a member of the Global Steering Committee of the Financial Institutions Industry Group of the firm.

    He advises clients on a variety of general commercial issues. His practice is focused on the areas of transactional and regulatory matters including but not limited to multinational financial transactions, commercial agreements and mergers and acquisitions.

    Gabriel has been referred to as “one of the best banking lawyers in Argentina” and as “a very professional and business-oriented lawyer with a profound knowledge of the law” (Chambers, Legal 500 and Latin Lawyer).

    He is also a member of the Board and Adjunct Professor of Law of Universidad Torcuato Di Tella and a Visiting Professor with the Centre for Commercial Law Studies, Queen Mary College, University of London.

    Adriana has over twenty years of experience in customs and foreign trade matters. She joined Baker McKenzie in 2001, became National Partner in 2005 and a Principal in 2018. She has prior experience working as legal director of Rules of Origin, Customs Procedures and Safeguards in the Mexican Ministry of Economy where she participated in the negotiation of several free trade agreements (FTAs) and in the first dispute settlement resolution cases initiated by Mexico against the US under the NAFTA.

    Adriana has been ranked a leading practitioner by Chambers and Partners at Chambers Global and Chambers Latin America as well as Legal 500 for eleven consecutive years. She was an associate in our Guadalajara and Washington, D.C. offices and currently Heads the Firm’s North America International Commercial Practice Group in Mexico City.

    Carolina Pardo joined Baker McKenzie in 1994 and is a Partner of the Firm since 2008. She is currently a member of the Global Steering Committee for the Firm’s TMT industry group and of the Global Steering Committee for the Firm’s Investigation, Compliance and Ethics Group. She was a member of the Global Steering Committee for the Firm’s Global Antitrust and Competition from 2016 and until 2020 and is currently a member of the Latam's Antitrust Steering Committee.

    She graduated as a lawyer and a specialist in International Contracts Law from Universidad de los Andes in Bogotá. She obtained a LL.M. with emphasis in International Private Law and Competition Law from the London School of Economics and Political Science.

    Over 25 years, she has advised major national and international clients on matters related to compliance with data protection, competition and consumer law rules. She has represented clients in investigations and submissions related to data protection and competition matters in Colombia and has successfully coordinated and prepared white paper proposals to national authorities on behalf of major industrial groups in Colombia.

    In 2016 Global Competition Review selected her as one of the 100 most influential women in antitrust. The last two Superintendents of Industry and Commerce have selected Carolina as a Non-Governmental Advisor to the Colombian Antitrust Regulator.
