Rachel A. Mongiello is a member in the Cole Schotz PC Litigation Department. Her practice and experience includes business and commercial litigation and arbitration and white-collar criminal defense. Rachel’s practice focuses on investigating, litigating, and defending claims of fraud, breach of contract, breach of fiduciary duty, minority shareholder oppression, unfair competition, and collusion. Her experience includes representing business owners in corporate governance disputes, representing hedge funds and investment firms in high-stakes litigation arising from complex real estate and financing transactions, litigating disputes between distributors and suppliers, assisting with and defending against government investigations, and evaluating and defending against civil and criminal fraud and antitrust claims in the pharmaceutical and financial sectors. Rachel’s practice has been recognized most recently in her selection as a “Rising Star” by New Jersey Super Lawyers.
Prior to joining Cole Schotz, Rachel practiced as a litigation associate with two firms in the greater New York City area. She also served as a law clerk for the Honorable Dolores K. Sloviter of the United States Court of Appeals for the Third Circuit, the Honorable Mary L. Cooper of the United States District Court for the District of New Jersey, and the Honorable Barry T. Albin of the Supreme Court of New Jersey.
Rachel graduated magna cum laude from Providence College and received her J.D., summa cum laude, Order of the Coif, from Seton Hall University School of Law. During law school, Rachel served on the Seton Hall Law Review as an Articles Editor and on the Moot Court Board. She won both the 2008 Ronald J. Riccio First-Year Moot Court Competition and the 2010 National Juvenile Moot Court Competition. At this competition, she was also awarded Best Brief and was recognized as the Third Best Oralist. Rachel also participated in Seton Hall's Constitutional Law Clinic, where she assisted clients in raising claims for constitutional violations against government entities.
Rachel is currently an active member of the Supreme Court of New Jersey District VI Ethics Committee, the Bergen County Bar Association, the New Jersey Women Lawyers Association, and Seton Hall University School of Law's Alumni Council, where she serves as co-chair of the Special Events Committee.
Susan Usatine is a member of Cole Schotz's Litigation Department. She is regarded as a litigator who understands how the Information Age has indelibly altered the way businesses make strategic decisions including the handling of high-stakes disputes.
Susan has served as trusted counsel to high-level entrepreneurs, private equity firms, and financial and accounting service professionals for more than twenty years. She represents domestic and international businesses in bet-the-company litigation in federal and state courts, mediation, and arbitration proceedings.
As a result of her successful and disciplined handling of fast-paced, multi-state litigation with enormous information volume, Susan spearheads the firm’s strategic planning in the area of litigation technology and is the founder and leader of the firm’s Discovery Services Practice Group.
In 2020, Susan was named Innovator of the Year by the New Jersey Law Journal and has been recognized as a United States’ Top 250 Women in Litigation by Benchmark Litigation for three years. Susan’s clients believe this honor recognizes the results she obtains in the courtroom and her keen understanding of technology’s effect on litigation strategy and outcome. Susan has answered sophisticated clients’ “more for less challenge” by using efficiency strategies in every matter. The game-changing litigation efficiencies she has developed and implemented are widely recognized as best practices throughout the legal profession.
