The Role & Responsibilities of EAPs in the EIA process

This training course has been designed to provide a solid foundation for newly qualified environmental professionals and candidate Environmental Assessment Practitioners (EAPs) as well as a refresher course for more experienced EAPs.


Janice Tooley is a practising attorney specialising in environmental law with 13 years prior experience in Environmental Impact Assessment (EIA) so she is able to give an up-to-date comprehensive explanation of the law as well as draw from practical experience to ensure a good understanding of an EAP's role and responsibilities in the EIA process, focussing on:

  • Regulation 13 of the EIA Regulations, 2014 (as amended)
  • Independence & objectivity
  • Knowledge, expertise & professional registration
  • S24J and other guidelines
  • Regulation 18 – decision-making criteria
  • Disclosure of material information
  • General application requirements
  • Screening Report and specialist protocols
  • Specialist terms of reference & integrating specialist findings

  • Reporting requirements (BAR, Scoping Report, EIA Report, EMPr, Closure Plan)
  • Timeframes and extensions
  • EAP liability (contractual, administrative and criminal)


The outcome of the training is for participants to be well familiar with the prevailing legislation, case law, and applicable guidelines that define the roles and requirements of EAPs in an EIA process.

    Janice has been practicing as an environmental attorney since 2013 and has a unique skill set in both environmental management and law. She initially trained in zoology, botany, ecology, and environmental management, and worked as an environmental consultant, facilitator, and environmental impact assessment (EIA) practitioner for many years before pursuing a career as an environmental lawyer. She is a director and co-founder of the newly established law clinic ALL RISE Attorneys for Climate and Environmental Justice, working pro bono for communities who cannot afford legal services.
