Tax Residency – What implications for Expats working in South Africa?


European companies operating in South Africa are often employing expatriates. There are many questions around the taxation of these employees. In some cases, these expats, after their posting, decide to remain in South Africa and apply for permanent residency. What taxation would these employees be subject to?


To unveil tax matters of foreign residents (and non-residents) in South Africa, we have invited 2 tax specialists from Mazars who will cover the following topics:

  • When will you be considered a South African tax resident?
  • What are the South African tax implications for non-residents working in South Africa?
  • What are the compliance requirements for non-residents working in South Africa?


The presentation will be followed by an extensive Q&A session.

    Althea Soobyah

    Director in Tax Consulting of Mazars South Africa

    Althea joined Mazars as a Director - Tax Consulting in May 2020 and focuses on all areas of corporate tax, including mining tax, corporate rules, transfer pricing controversy and tax dispute resolution.

    She was previously employed by one of the Big 4 accounting firms where she was involved in advising clients on matters related to Dispute Resolution, Tax Administration, and providing tax advisory services to clients across multiple sectors such as mining, telecommunications, IT and retail.

    Prior to her employment with a Big 4 she spent 14 years the South African Revenue Service and held various roles from legal tax consultant to Senior Manager and Senior Specialist within Head Office and the Large Business Centre. Her primary focus in these positions was to provide advisory services to the regional offices on Corporate Tax issues including but not limited to areas such as mining, transfer pricing, general tax, audit related assistance and dispute resolution assistance as well as to provide input to tax policy at a head office level.

    During her time at the South African Revenue Service, Althea also participated in and contributed to tax policy initiatives driven by SARS from a corporate tax, mining as well as research and development perspective.

    Devs joined Mazars in 2021 as a Manager -Tax Consultant in the Gauteng Tax Practice. Her area of expertise includes Commercial and Corporate Law specializing in Corporate Tax, estate planning, Trust law, the administration of deceased estates and contract law. Her experience includes providing advice on a variety of tax issues such as Corporate roll over relief (restructuring and M&A), the registration and assessments of Public Benefit Organizations; tax due diligence investigations; objections and appeals; various tax compliance related matters and the drafting of wills, trusts and a wide range of commercial contracts She is an admitted Attorney, holds an LLM in the Law of Taxation and a postgraduate diploma in financial planning.
