With the exponential growth in international business transactions around the globe, an increase in cross-border activities also necessitates the settlement of cross-border disputes even when parties need more willingness to submit to a particular jurisdiction. This hurdle makes the utilisation of cross-border Arbitration in resolving cross-border disputes more difficult, mainly due to the need for recognition and enforcement of arbitral awards. From a practical perspective, this aged-long hurdle still poses specific difficulties, uncertainties and challenges, including but not limited to the resolution of international cross-border disputes. Commercial and investor-state arbitration in Nigeria has become a concern due to the increasing number of disputes arising from it. This has led to debates about the fairness and transparency of the system. One of the major concerns about commercial arbitration is the high cost of arbitration, which makes it inaccessible to smaller businesses and individuals. This has led to calls for establishing more affordable and transparent arbitration processes. Another concern is the lack of diversity in the appointment of arbitrators, which can lead to biased decisions. In addition, the enforceability of arbitral awards has been a major challenge due to inadequate legal frameworks and lack of compliance by some parties.

An Arbitrator plays a fundamental role towards ensuring that the aim of justice is guaranteed in an Arbitration proceeding. Amidst these numerous roles, the core of an Arbitrator’s role also demands that an Arbitrator maintains an equidistant position with the parties. Albeit, the concept of bias is subjective. Nevertheless, bias must be appropriately managed by an Arbitrator without any manifestation of biased conduct(s). This way, an Arbitrator can salvage the possible suspicion and, consequently, the unjustifiable challenge of an award. However, this does not deprive Arbitrators of their powers to exercise their discretion in the best way possible without contravening arbitration rules/practices to ensure that justice is not only done in the delivery of an award but must be seen to have been done.

Arbitration is one of the most preferred options in resolving disputes in cross-border commercial transactions. The increase in recognition and enforcement of awards is one of the various considerations for resorting to it. Arbitration clauses are the fine print of all contracts upon which arbitration is established. African countries have risen along with others in ratifying the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards. Similarly, Article 27 of the AFCFTA Protocol provides for arbitration as an alternative route to resolving disputes (a very good signal of confidence in arbitration). Despite these bold steps, numerous challenges exist to the recognition and enforcement of arbitral awards encountered by most African States.

As widely practised as Arbitration is, specific jurisdictional trends still exist, including but not limited to delocalisation, expedited proceedings, multi-contract arbitration, procedural innovations, electronic filing of arbitration pleadings, and technological advantage. Delocalisation, for instance, came to life due to the willingness of parties to submit to a neutral arbitral process against the arbitral laws of the parties’ respective countries. Beyond this, the UAE Arbitration Law, Dubai International Arbitration Centre (2022) Rules encourages the use of technology during Arbitration hearings and deliberations and its procedural innovations aimed at reducing time, cost and environmental concerns. Are there similar provisions in the laws guiding Arbitration and ADR in the USA and Australia? Any lessons for Nigeria and Africa generally?

The first challenge of the manufacturing industry is encountered when a non-efficient and ineffective disputes resolution mechanism is adopted during the construction and installation phases of the required infrastructure(s) and machineries. On the 26th of May 2023, Nigeria passed the new Arbitration and Mediation Act, 2023, which repealed the Arbitration and Conciliation Act, Cap. 18A, LFN 2004, after about thirty-five (35) years in operation. The new Arbitration and Mediation Act has been described to be a more comprehensive legal framework for the conduct of Arbitration and Mediation proceedings in Nigeria, giving room for initiatives and utilisation of technological innovations towards increased operational efficiency and effective dispute resolution either by Arbitration and or Mediation, including but not limited to New Technologies (NT), Technology Mediated Dispute Resolution (TMDR), Online Dispute Resolution (ODR) and Hybrid Alternative Dispute Resolution (HADR).

Arbitration and extensively Alternative Dispute Resolution, just like the traditional court system, is geared towards ensuring justice. While Arbitration does not conform with procedural dictates of the traditional court system, it nevertheless produces the same substantive outcome. With this understanding, it stands to reason that Arbitration is no less an inferior dispute resolution mechanism and should be further enhanced to increase how the public can also access this justice system. Moreover, the current overwhelming state of our traditional court system has further necessitated the urgency to revisit the role the traditional arbitration and Alternative Dispute Resolution have played towards fostering the growth of justice delivery in Nigeria.

PRESIDENT & CHAIRMAN OF COUNCIL'S REMARKS



It is indeed an immense honour and great privilege to welcome, on behalf of the Nigerian Institute of Chartered Arbitrators (NICArb), our esteemed members and guests here today, at the heart of Nigeria's Capital, Abuja, Nigeria, to attend our 2023 Annual Conference. I also welcome those participating virtually.

 

The NICArb's Annual Conference is an impactful gathering of professionals converging to further the growth of Alternative Dispute Resolution and focusing on Arbitration practice in Nigeria. Over the years, our Conference has delivered premium value to participants by equipping them with a wealth of experience and knowledge that shape the practice of Arbitration. NICArb has been a significant driver in building a nationalist and pan-African Arbitration practice by being at the forefront of innovation, professionalism, and excellence.

 

Our Annual Conference is remarkable for hosting Arbitrators/ ADR experts and practitioners within Africa and globally to deliberate on issues and prospects affecting Arbitration practice in Nigeria and across the Continent of Africa at large through the provision of constructive recommendations at par with leading arbitration practices globally.

 

Our speakers will be sharing insights on the theme "Repositioning Arbitration and ADR Practice in Africa." We have chosen this theme to redefine and strategically elevate the practice of Arbitration through candid introspection while reflecting on key steps Africa must take to earn and occupy its rightful place globally. I am confident that the quality and experience of our speakers/ panelists will ensure that the relevant topics are discussed in the central theme and sub-themes ranging from 'Emerging Arbitration trends in advanced countries,''Concerns Arising from Commercial and Investor-Africa,' 'Managing Bias in Arbitral Processes,' 'The Nexus of Technology and Arbitration, Cross-border Practice of Arbitration' and 'ADR within the African Continent and beyond, dissecting the newly enacted Arbitration and Mediation Act, 2023', amongst others.

 

I commend the Governing Council, Registrar/ CEO and Management of the Institute, and 2023 Hybrid Annual Conference Planning Committee for their tremendous efforts in putting together a promising conference with great speakers/panelists and the delegates who make the conference a forum of networking, learning, and sharing of experiences.

ANNUAL CONFERENCE PLANNING COMMITTE CHAIRMAN INTRODUCTORY REMARKS

Distinguished and Eminent Personalities present here today, it is with great delight and privilege that I welcome you all, on behalf of the 2023 Conference Planning Committee, of the Nigerian Institute of Chartered Arbitrators' (NICArb) 2023 Hybrid Annual Conference, holding in the captivating city of the Federal Capital Territory, Abuja, between the 15th - 17th of November, 2023.


Year after year, NICArb's Annual Conference has proven to deliver such a phenomenal experience for arbitrators wo converge from Africa and beyond to examine critical issues in the practice of arbitration in Nigeria and Africa at large whilst providing solutions and recommendations. This year's Conference, ''Repositioning Arbitration and ADR Practice in Africa'', will not be any less different. We have secured some of the finest, and exemplary arbitrators, ADR practitioners and experts from all over the world with varying professional backgrounds, ranging from the Academia, the Bench, the private sectors and policy-makers. Our carefully curated and excellent choice of panelists will not only do justice to the theme and sub-themes set out for this Conference but also inspire confidence in us regarding the potential of Arbitration in Nigeria and Africa, extending to the world at large.


At this year's Conference, we shall discuss the scope and quality of our Arbitration practice in Africa and how it should be geared towards repositioning Arbitration and Alternative Dispute Resolution (ADR) at the forefront of dispute settlement on the Continent. We expect that participants would be better equipped to practice Arbitration and ADR and be seized of global trends, innovation and development as the Conference addresses varying issues in our Arbitration practice, ranging from Cross-border Practice of Arbitration and ADR within the African Continent and beyond, Managing Bias in Arbitral Processes, Emerging Arbitration trends in Developed Countries, Climate and Environmental Disputes in Africa, Mitigating and Arbitrating Construction Disputes, the Nexus of Technology and Arbitration, Concerns Arising from Commercial and Investment Arbitration in Africa, amongst several others. 


We at NICArb are confident that this Conference would not only enrich our practice of Arbitration as Arbitrators and ADR practitioners but also help to bridge the apparent gaps within Africa. Hence, we encourage all participants to give their best attention and commitment to getting the best out of this Conference, as it is bound to provide every Arbitration practitioner with unusual insights, not leaving out the novel areas in the newly enacted Arbitration and Mediation Act, 2023.

 

Delightfully, on behalf of the Annual Conference Planning Committee (ACPC), I welcome you to Abuja and ask that you relish our beloved nation's capital, the centre of unity and a melting pot of cultures, along with its iconic scenery and edifices.
