GTCC’s 4th update on COVID-19: New Relief Measures for Companies in Thailand

The German-Thai Chamber of Commerce (GTCC) has been watching the situation of the novel Coronavirus (COVID-19) outbreak closely in order to fully support our members and partners. In co-operation with the Germany Trade & Invest (GTAI), we are pleased to share with you updated informatiton on the relief measures for companies in Thailand as follows.
Labor Cost and Labor Market Measures
Social Security Fund
  • The deadline for employers to submit compulsory social security forms and remit contributions is extended for the salary of March 2020 to 15 July 2020; for the salary of April 2020 to 15 August 2020; for the salary of May 2020 to 15 September 2020.
  • Reduced rate of the contributions by employers from 5 to 4% from March 2020 to August 2020. Rate for insured persons reduced from 5 to 1% for the salaries from March 2020 to May 2020 and reduced rate of 4% from June 2020 to August 2020.
  • Voluntarily insured persons: Social Security Fund contribution reduced to 86 Baht per month (from 432 Baht)
Thailand’s Ministry of Labor is expected to issue regulations and an announcement to formalize and implement this Social Security Office policy on COVID-19 assistance measures:

1. Unemployment benefits due to Force Majeure
Social Security Office to apply section 79/1 of the Social Security Act pays compensation to employees who have had to cease working and are not receiving wages from the employer, but whose employment has not been terminated, as a result of one or more the following events related to the COVID-19 pandemic:
  • The employer orders the cessation of specific employees work due to the force majeure obstructing normal business operations.
  • The employee has to cease working due to the force majeure, with the approval of the employer.
  • The government orders the employer to close the business as a preventive measure for the pandemic of disease.
Employees receive compensation during the work cessation of 62% of their daily wages contributions to the Social Security Office for a maximum of 90 days.

2. Benefits in the event of unemployment amidst the economic crisis
Regulation to declare an economic crisis from 1 March 2020 to 28 February 2022 would allow the Social Security Office to pay compensation to employees whose employment contract ends for the following reasons:
•     Termination by the employer entitles the employee to receive compensation of 70% of their daily wages contributions to the Social Security Office limited to 200 days for each termination.
•     Resignation or expiration of definite employment entitles the employee to receive 45% of their daily wages contributions to the Social Security Office limited to 90 days for each period of unemployment.

Payments to informal workers who are not covered by a social security welfare scheme
Freelancers, self-employed persons who register on the website raomaithingkun.com "Nobody will be left behind" and qualify will receive 5,000 Baht monthly from April to September 2020. Ministry of Finance expects 9 million eligible persons with informal jobs. Payments are via direct transfers or through electronic wallets.
Bank of Thailand: Additional measures to assist SMEs and to stabilize corporate bond market
  • Loan payment holiday of 6 months for SMEs with a credit line not exceeding 100 million baht. They can pause payments of principal and interest for 6 months. This payment holiday will not be considered as a missed payment and will not impair credit history.
  • Soft loans to support liquidity for SMEs with a concessional interest rate of 2% per annum and interest-free for the first 6 months. Interested SMEs can apply for soft loans at their banks. SMEs must operate domestically, are not listed in the Stock Exchange of Thailand or the Market for Alternative Investment, have a credit line with a financial institution not exceeding 500 million baht and still have a performing loan with normal repayment status or arrears of less than 90 days (non-NPL) as of 31 December 2019. The maximum drawdown for the soft loan is 20% of the loan outstanding as of end-December 2019.
  • Market liquidity enhancement to stabilize the corporate bond market. BOT and the Ministry of Finance establish a Corporate Bond Stabilization Fund (BSF) to provide bridge financing to high-quality firms with bonds maturing during 2020-2021, at higher-than-market ‘penalty’ rates. Eligible corporate bonds/issuers must be at least an investment grade, have raised the majority of their funding needs through other means such as bank loans or capital increase, have a clear long-term financing plan and meet other conditions as set out by the BSF’s investment committee.

Other Measures
  • Electricity tariff will be cut by 3.0% for all categories of power users from April to June. Minimum charges for medium-sized and large power consumers during this period is waived. Metropolitan Electricity Authority (MEA) and the Provincial Electricity Authority (PEA) will return cash deposits to households and small-business owners.
 
Further information
  • Thailand's visa relief measures: The person whose visas has expired from 26 March 2020 will be automatically extended to 30 April 2020. There is no need to apply for a visa extension at Immigration Office for this period and will not be fined THB 500 per day for this case. Aliens who are due for 90 days reports between 26 March 2020 and 30 April 2020 are temporarily exempted from reporting in this period until further notice. (Immigration Bureau, 07/04/2020) More
  • All commercial flights into Thailand have been banned until 18 April 2020, to prevent clusters of Covid-19 infections among travellers from abroad (CAAT, 06/03/2020) More
