MBAH Advocates for you! 
The MBAH Legislative Committee works diligently to monitor federal and state/local issues that impact mortgage lending and advocates on your behalf.   
  • Appraisal Management Company (“AMC”) licensure under Hawaii Revised Statute 466L was sunsetted by the State of Hawaii DCCA in June 30, 2023. This means that lenders who use AMCs are no longer able to order appraisals using this method for certain “Federally related”(1) mortgage transactions, and lenders may have unknowingly violated regulations by using AMCs to order appraisals since June. (See the full Dodd-Frank rule in footnote #2.) MBAH is working jointly with other trade organizations that represent financial institutions in Hawaii and the legislature to retroactively re-institute the same AMC license protocol that was used prior to June, 2023 in this 2024 legislative session.  
  • Many of you may be aware that hundreds of condominium projects in Hawaii are underinsured for hurricane perils due to excessive costs and/or lack of availability. This makes loans secured by condo units in these projects ineligible for Fannie Mae and Freddie Mac loan programs, and most portfolio lenders will not finance these units either. MBAH is working closely with a group of insurance professionals, other trade organizations that represent financial institutions in Hawaii, and legislators to draft legislation to reactivate the Hawaii Hurricane Relief Fund to expand insurance options in this 2024 legislative session.   
  • MBAH has provided written support of proposed Senate Bill 3502, which would limit the use of trigger leads. To find out more and to express your support, click on the following link:
