Dear Subscriber, 

Prime Minister Muhyiddin Yassin had announced on May 1 that the Government will implement a Conditional Movement Control Order (CMCO) beginning May 4 to ease the partial lockdown and to allow almost all businesses to operate (except the sectors that are listed as prohibited activities by the National Security Council). All operations are subjected to strict SOPs issued by the Government. View all SOPs here

IMPORTANT: For any confusion that all companies resuming operations MUST register with MITI on CIMS 3.0 by 12th May, please read the following:

This is a voluntary declaration by companies that are allowed to operate under CMCO (not in the list of prohibited activities issued by the National Security Council) that they will commit and adhere to the SOPs by authorities.

Companies that have previously applied to MITI to operate via CIMS 2.0, regardless of application results do not need to make this declaration.

Once registered, the CIMS 3.0 system will issue an endorsement letter with a QR code which can be displayed at the business premises. This initiative is aimed to support companies in gaining confidence among their customers and clients that they are complying to the strict SOPs.
 
Example: Services like Elderly Home, Nursery, Kindergarten – are NOT essential/critical but can now operate under CMCO starting 4 May. Hence if they have this letter & QR code, their customers may be more confident to send their kids or elderly.

In summary:
  • It is a voluntary declaration, NOT a registration or application to MITI to operate.
  • Who can apply? Companies which are NOT in the list of prohibited activities can voluntarily apply via CIMS 3.0 by 12 May 2020. See 3 Steps below. 
  • Companies under essential/critical/approved list who have previously made applications via CIMS2.0 need not apply again.

CLOSING SOON! The Ministry of Finance is working with various parties to seek views on socio-economic issues and proposed solutions for input into formulating the 2021 National Budget. In regard, the BMCC has been invited to submit a Memorandum for input into the preparation of the 2021 Budget which is expected to be tabled in Parliament in early October 2020. 

Hence we are now gathering issues and recommendations from our business community for inclusion in the Memorandum. We look forward to hearing your feedback in the questionnaire above, or click here to access. 
 

2nd BMCC Energy Committee Meeting 2020 Held Online

On 8 April 2020, the BMCC Energy Committee held its second committee meeting of 2020, this time however utilising the online conveniences of Microsoft Teams. The last committee meeting was held back in February 2020. 

Chaired by Mohamad Hanif Hashim, who is also the General Manager of Petrofac Malaysia, the committee meeting was attended by fellow members from the Energy, Oil & Gas sector. The main agenda of discussion was the challenges faced during the MCO and action plans taken collectively as a group to address some of the issues faced. The BMCC Energy Committee keeps a positive outlook and have already made plans for upcoming initiatives for the remainder of 2020. The meeting also covered a debrief on the BMCC Energy Outlook 2020 event which was held in February, the last physical event organised by the BMCC before the MCO initiation.

Mental Health: Adapting in Challenging Times (Webinar, 6 May)

In collaboration with the Malaysian Mental Health Association (MMHA) and Riverside Consulting (CIC) UK, the BMCC is organising a mental health webinar to provide an opportunity for attendees to better understand current and existing mental health challenges and to gain knowledge and techniques to start addressing these. A panel of mental health experts from Malaysia and the UK will answer audience questions on a potential range of topics such as managing Loneliness, Depression, Stress, Bereavement, Anxiety and Trauma and how best to support children at home with neurodevelopmental conditions (e.g. ADHD, ASD)

Berkeley Group St George & Knight Frank Malaysia launch landmark London development Grand Union

Berkeley Group St George has launched its new development Grand Union, a landmark new waterside development that will see the regeneration of a 22-acre site into a vibrant new neighbourhood for North West London, delivering much needed homes and jobs in the London Borough of Brent. 

Grand Union will provide a range of local amenities for the area including a nursery, a commercial gym, a new local bar and restaurant, a health centre and a local convenience store for the benefit of the whole neighbourhood. The 5,000 sq ft community centre will encompass a community garden and kitchens and provide workshops and flexible event spaces for existing and new residents.

MDEC - e-Dagang Expo (EDX) (4-8 May)

Recognising the imperative need for SMEs to embrace digital transformation and better mitigate the immediate impact of Covid-19, the Malaysian Digital Economy Corporation (MDEC) is hosting its first e-Dagang Expo (eDX).

Loosening of Covid-19 MCO Restrictions and re-Opening of the Economy 

The Malaysian Government has on the 1st May 2020, announced that most economic sectors and business activities will be allowed to operate from 4th May 2020 based on normal operating capacity and operating hours but subject to certain conditions and Standard Operating Procedures (SOPs). Schools, colleges and institutes of higher education will however remain closed 

The SOPs comprise a general SOP for re-opening the economy and various other SOPs applicable to sector-specific companies and businesses issued by the relevant government ministries having jurisdiction over such sectors.

ACCA insights report from Covid-19 Global Survey: Inside business impacts and responses

ACCA has published an insights report discussing the impact of COVID-19 so far on organisations and the global business community. The survey supporting this report was issued on 13 March 2020 and gathered responses from over 10,000 members and other stakeholders across the world from over 100 countries.
 
Organisations of all sizes, sector or country of operation are being hit across the value chain by the COVID-19 pandemic. which has led a significant number of respondents to see a fall in customer demand, major supply chain disruptions, deferred launches of new products and services, and capital investment plans being put on hold.

Millions lost in APAC carve-out deals as sponsors explore new investment opportunities

The number of carve-out acquisitions is expected to rise as businesses in Asia-Pacific (APAC) look to restructure because of the COVID-19 turmoil. Those that do should approach with a note of caution after research revealed around a fifth of carve-outs result in millions of dollars wasted because of inefficiencies.

While the deal economics of carve-outs can be very attractive, an independent survey, commissioned by TMF Group, found that 34% of senior executives from private equity firms with buy-side experience and 27% from corporations said their most recent cross-border carve-out failed to deliver on expectations, with 24% and 19%, respectively, saying costly overruns significantly impacted the deal. Resumption of Malaysia Immigration Department's Services
  1. All foreigners who have overstayed from 1st January 2020 till 14 days after the end of MCO, can leave Malaysia without being blacklisted or issued compound.
  2. All pass facilitation for foreigners whose Pass has expired from 1st February 2020 can apply for the Special Pass (to legalise the overstay) at any immigration office within 30 working days from the end of the MCO period. 
  3. All appointments for immigration counter services (except Visa, Pass, Permit Division and Expatriate Division) have to be done through the online system at www.sto.imi.gov.my which can be accessed starting 8th May 2020 (Friday). No appointments are needed for transactions at the Security and Passport Division.
  4. All immigration counter services at UTCs nationwide will resume operations after the end of MCO period.

Pushing Back on the CMCO

A majority of States have resisted the reopening of the economy on 4 May but do they have the authority to stop businesses if they are permitted by the CMCO?

On 1 May 2020, the Prime Minister announced that all business sectors would be allowed to resume operations if they did not fall within a list of prohibited activities, starting 4 May 2020. These pronouncements have come to be referred to as the Conditional Movement Control Orders (CMCO). Although the announcement was initially well received, concerns that a premature reopening of the economy to such an extent could result is a new spike in the rate of infections, continued to circulate.
