Navigating ones way through a Law Society investigation can often be a stressful and difficult process. On March 5, 2020, the "Guidelines for Disclosing Information to Law Enforcement" enacted by the Law Society of BC came into effect. The Guidelines set out a new protocol by which the Discipline Committee will consent to the Executive Director disclosing any information in its possession to law enforcement which, by necessary implication, includes a referral of lawyers to criminal investigation. This adds another layer of stress and complexity for lawyers facing a Law Society investigation.
